#485....big brother refines the art of doublespeak

You know, one mistake we keep making here is thinking that the journals we create here are in fact ours...they're not - they're AOLs...and apparently, they can do with it whatever they want...

I quote direct from the Big Brother, Master of Doublespeak:

"Although you or the owner of the Content retain ownership of all right, title, and interest in Content that you post to any AOL Service, AOL owns all right, title, and interest in any compilation, collective work or other derivative work created by AOL using or incorporating this Content. In addition, by posting Content on an AOL Service, you grant AOL, its parent, affiliates, subsidiaries, assigns, agents and licensees the irrevocable, perpetual, worldwide right to reproduce, display, perform, distribute, adapt and promote this Content in any medium."

Now I have to wonder....where exactly does "informed consent" come into play - when they also play their CHUMP card...uh excuse me - their trump card - of changing the TOS rules whenever they feel like it - without due notice or agreement from the other party....

I quote:

"AOL reserves the right to make changes to these guidelines at anytime and you agree to be bound by any such changes. Please check these guidelines periodically for any changes."

At the very least - they should email all members whenever new policies are instituted - so that we can then review and decide whether or not we want to agree to them.

But wait - that would then oblige Big Brother to playing fair. 

Instead of targeting us as fair game...

The Queen Chump wants to know your thoughts on this one.

That means that AOL has the right to quote, or reproduce in full, any of your work or words, anywhere else on their service for any reason, and that they then own the rights to that portion of your work, only in the context that they have reproduced it. For example, if AOL quotes a journaler's words on one of their content pages, the content page, including the journaler's words as they appear there, are property of AOL. The journaler still retains all ownership of the words as they appear in their journal. It does not have anything to do with deleting journal content.

BTW, that part of the TOS has existed pretty much unchanged for years, I believe.

AOL hath smeared their lips with the sweet salve of Bovine Scatology.

What good is a policy they don't live by...?

What other policies do they NOT live by?  Protecting our private data?  Our credit information?  Our e-mails?  

What else do they flush... whether it truly goes down the toilet, or into the hands of someone with questionable motives?!

a lot of people are paying a lot of attention to how aol decides to resolve this. It would be a real shame if we all had to take the party elsewhere. judi

I began cutting and pasting my Journal to MySpace last night. The only reason I have remained with AOL was because of J-land. That sentiment might not be worth the risk of having AOL cornhole me as they did Armand. Therefore, I will maintain both Journals, and I will consider what move I will make as soon as the Armand situation has been resolved.

I don't like the sound of any of this.  I Hate knowing that they are scrutinizing our work.  But maybe all the ISPs operate this way.  Homeland Security?  EEyuk.  Ugh and Barf.  Is this still My country Tis of Thee, Sweet Land of LIberty?
It's JLandia that's keeping me with AOL.  If we decide to opt out of AOL, let's make it a mass move together to someother ISP.  That could hurt them in the Pocket, no?  And we could keep the "Hood.  Yes?  So now I'm going to do the Heartsong thing, i.e., all my entries get done first in my Documents and then Cut and Pasted to My Journal.  BUT - who's scrutinizing our documents???  OOooo Paranoia, here I come!  Sheila

Wow, this is REALLY food for thought. Somehow it was always in the back of my paranoid mind every time I made an AOL blog entry. Should I start cutting down on my creativity and saving it for my private, off-line journal???? I'd hate to have my blog become a best-seller in Bombay(lol) without my knowledge.....Jon
